These Terms of Service ("Terms") govern your access to and use of the Noah's Beacon Systems platform, including the Noah's Beacon mobile application, hardware, and related services (collectively, the "Service"), provided by Masterpiece CNC Prototyping LLC ("we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Important safety notice. Noah's Beacon is a supplemental personal-safety tool. It is not a substitute for calling 911 or your local emergency services, and it is not a guaranteed emergency-response, monitoring, or rescue service. The Service depends on factors outside our control — including device battery, Bluetooth and cellular connectivity, GPS availability, network and carrier delivery, and the availability and action of your emergency contacts. We do not guarantee that any alert will be transmitted, received, or acted upon. Always contact official emergency services when you are able to do so.
1. Eligibility & Accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. You are responsible for the accuracy of the information you provide, for maintaining the security of your account, and for all activity under your account.
2. Use of the Service
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to misuse the Service, including by sending false alerts, interfering with its operation, attempting to reverse engineer it, or using it in any way that could harm others or violate applicable law.
3. Emergency Contacts & Notifications
The Service allows you to designate emergency contacts who may be notified, including by SMS, when you activate an alert. By designating a contact, you represent that you have that person's permission to add them and to have them notified on your behalf. SMS messaging is subject to the terms described in our Privacy Policy, including opt-out (reply STOP) and help (reply HELP) instructions. Message and data rates may apply.
4. Location
The Service uses location data to support its safety function. You control location permissions through your device settings. Disabling location may reduce the effectiveness of alerts, though an alert may still be sent without location.
5. Hardware
Certain features require Noah's Beacon hardware. You are responsible for keeping hardware charged, updated, and in working condition. We are not responsible for failures resulting from damaged, depleted, modified, or improperly maintained hardware.
6. No Warranty
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that alerts will be delivered or acted upon.
7. Limitation of Liability
To the fullest extent permitted by law, Masterpiece CNC Prototyping LLC and its owners, officers, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or inability to use the Service, including any failure or delay in transmitting, delivering, or acting upon an alert. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
8. Indemnification
You agree to indemnify and hold harmless Masterpiece CNC Prototyping LLC from any claims, damages, or expenses arising out of your use of the Service or your violation of these Terms.
9. Intellectual Property
The Service, including its software, hardware designs, branding, and content, is owned by or licensed to Masterpiece CNC Prototyping LLC and is protected by intellectual-property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as intended.
10. Changes to the Service or Terms
We may modify the Service or these Terms at any time. We will post updated Terms with a revised "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
11. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time.
12. Governing Law
These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws principles, except where otherwise required by applicable law.
